A former security supervisor who left a motorcycle pillion rider permanently disabled in a road accident was sentenced to a day’s jail and fined RM5,000 by the magistrate’s court today.
Mohd Kamil Mokhtar, 60, was sentenced by magistrate M. Saravanan after he pleaded guilty to the charge.
Kamil, while trying to hold back his tears, thanked the court and expressed his gratitude after the sentence was handed down to him.
He was charged with driving his Naza car recklessly and dangerously causing an accident with a motorcycle on which a 16-year-old girl was a pillion rider.
The charge under Section 42(1) of the Road Transport Act 1987 carries a jail term of not more than five years and a fine not less than RM5,000 and not more than RM15,000 and licence suspended for not less than three years, if convicted.
In pleading for leniency, Kamil, who was unrepresented, said he is the sole breadwinner of his family and has a child who is still in school.
“I am suffering from diabetes and gout. I also regret my action,” he said.
According to the facts, a car suddenly hit the victim who was a pillion rider on a motorcycle her brother was riding at the traffic lights in Jalan Wangsa Maju heading towards Genting Kelang.
The accident caused the victim to suffer severe injuries on her head which left her permanently disabled while her brother sustained bruises all over the body.
