The Sessions Court here has ordered national taekwondo sportswoman Nur Dhia Liyana Shaharuddin to make a public apology to a disabled senior citizen who won a lawsuit against her, over allegations of being assaulted at an LRT station two years ago.
Lawyer Datuk Dr S. Arunan, who represented Placid P. Rodriguez, 71, told the press that Sessions Court judge Lalilatul Zuraida Harron @ Harun ordered for Nur Dhia, 25, to have her written apology published in the newspaper in one month from the date of the order.
Arunan said the court made the decision in chambers after allowing the suit filed by Rodriguez, who is partially blind and deaf.
“The court also orders for Nur Dhia to pay RM1,000 in general damages and RM88 in special damages, as well as RM1,000 in costs to the plaintiff,” he said after the case was brought up for decision in chambers here on Tuesday (April 9).
In the statement of claim, Rodriguez said he boarded the LRT train to Putra Heights on July 6, 2017, and upon reaching the station, had allowed other passengers to go out of the train to avoid being pushed.
He said he was wearing a hearing aid at all times, and that the defendant later kicked him four times on his chest and other parts of the body.
He claimed that he continuously begged the defendant to stop assaulting him, but she did not.
As a result from the defendant’s action, the plaintiff claimed to have pain and mental and emotional stress. He claimed to be traumatised to go out on his own and feared that the same incident would repeat itself.
He sought a written unconditional, unqualified and unreserved apology by the defendant: general damages; special damages of RM88.78; aggravated and exemplary damages; and other relief deemed fit by the court.
Meanwhile, Arunan also told the press that the lawsuit was filed not for the sake of money, but to seek justice.
“What is more important is for the defendant to apologise to my client,” he said.
