The Indonesia Financial Services Authority (OJK) cannot interfere in the insurance dispute between Asuransi Allianz Life Indonesia and its consumers, since the dispute has been filed to the Criminal Investigation Unit of the Indonesia National Police (Polri).
"Consumers have chosen to bring a complaint to the Criminal Investigation Unit, if it has entered the legal domain, then it is not in OJK’s area," said Tirta Segara, Board of Commissioners Member at OJK on Consumer Education and Consumer Affairs, on Wednesday (10/04/2017).
OJK, as the supervisor of financial services institutions, will invite the insurance industry to communicate in relation to consumer protection. "For the case of Allianz, we will talk to the industry. OJK has also conduct market conduct," he said.
Tirta also said consumers should understand the risks and carry out obligations related to consumer protection. "Consumers should understand the risks, but if the issue of protection, OJK will provide optimally, because the engagement is the consumer and the financial services business, then OJK will facilitate if there is a complaint," said Tirta.
He also said OJK has received much public reporting on complaints relating to many sectors of the financial services industry, not just insurance. "We received many complaints, and we facilitated to be resolved by business actors," said Tirta.
Meanwhile, Asuransi Allianz Life Indonesia claims that its business is not disturbed by the criminal case involving their former directors, and insurance services to customers currently running normally.
Head of Corporate Communications of Allianz Indonesia, Adrian D.W, some time ago said that Allianz runs a normal claim submission process to customers related to the case of claims of Ifranius Algadri customer claims. "Allianz has no intention of complicating or rejecting this claim," he said.
Allianz's statement is related to the criminal case that wrapped around two former Allianz high-ranking, former President Director of Asuransi Allianz Life Indonesia Joachim Wessling and Claim Manager of Asuransi Allianz Life Indonesia Yuliana Firmansyah.
Two former high officials have been appointed by the Jakarta Police for allegedly violating Article 8 paragraph 1 letter (F), Article 10 letter (C), and Article 18 juncto Article 62 paragraph 1 juncto Article 63 letter (F) Law RI Number 8 years 1999 on Consumer Protection.
